AGREEMENT FOR HIRE

THE OWNER AND THE HIRER AGREE AS FOLLOWS:

1. The Owner shall hire live plant(s) to the Hirer and the Hirer shall hire the live plant(s) from the owner upon these terms.
2. The Balance due for the hire period will be payable at the end of the Term of the hire at the time the plants are pick up.
3. The Hirer agrees to hire the Live Plant(s) specified on the face of the Order for the Hire Period and to pay to the Owner the charges specified thereon.
4. The Hirer shall pay to the owner 25% deposit specified on the face of this Agreement for the hire of plants at the time of signing and accepting the quote.
5. The Hirer acknowledges to have this day received delivery of the said hire plants in good condition and that no warranty express or implied is given by the owner as to the suitability of the hire plants for the hirer's purposes.
6. The Hirer will not sell, encumber or in any way part with possession of the live plant(s) or attempt to diminish the owner's title to the live plant(s) or the Owner's right to the return of the live plant(s).
7. The Hirer is responsible for all live plant(s) on Hirer from the time of delivery to the time of scheduled pick up and shall indemnify the Owner against the loss of or damage to the live plant(s), whether by fire, theft, accident, negligence or otherwise.
8. The Hirer will pay to the Owner on demand any costs and expenses lawfully and necessarily incurred by the Owner in protecting his interest in the live plant(s) under this Agreement or in repossessing or endeavouring to repossess the live plant(s) or issuing any authority to repossess the live plant(s).
9. The Hirer will permit the Owner or any person authorised by the Owner, to enter on any premises occupied by the Hirer in which the live plant(s) is or is believed by the Owner to be located and repossessing plants for the purposes of inspecting the live plant(s) or serving any notices or demand in relation to the live plant(s).
10. The Hirer shall take all reasonable care to ensure that the live plant(s) are maintained carefully in accordance with the instructions provided to Hirer from the Owner.
11. The Hirer agrees that the Owner will make the arrangements to pick up the live plant(s) at the end of the hire period.  In the event that the Hirer has not made available the live plant(s) for pick up by the Owner, the Hirer shall pay the Standard Contract Daily Rate.
12. If the daily Hire amount is not paid in 7 days after the hire period the daily hire amount doubles until the return of the plant(s).
